US Court Allows Trump’s Tariffs to Remain in Effect During Appeal A U.S. federal appeals court in Washington, D.C., has allowed President Donald Trump’s sweeping tariffs to stay in place while it reviews a lower-court decision ruling them illegal. The lower court had found that Trump exceeded his authority by imposing the tariffs under the International Emergency Economic Powers Act (IEEPA). The Court of Appeals for the Federal Circuit scheduled arguments for July 31 to examine whether the tariffs are permissible under the law, but for now, they will remain enforced. These tariffs include duties on imports from most U.S. trading partners, as well as Canada, China, and Mexico, and were used by Trump as leverage in trade negotiations.
The May 28 lower court ruling declared that only Congress has constitutional authority to impose tariffs, not the president, and that Trump overstepped his powers. The Trump administration appealed quickly, seeking to keep the tariffs in effect during the legal process. The case involves lawsuits filed by small U.S. businesses and states, arguing that the tariffs are unlawful and not justified under the emergency law. Courts have generally ruled against the tariffs so far, but this appeal keeps the tariffs operational for now. This ruling impacts markets and supply chains, but does not affect other tariffs established under traditional legal authorities, such as those on steel and aluminum.
