If Court Ruling Stands, Trump Likely to Shift to Other Tariff Strategies

 



A recent ruling by the Court of International Trade found that  President Donald Trump overstepped his legal authority in imposing tariffs under the International Emergency Economic Powers Act (IEEPA). While an emergency stay currently temporarily keeps the tariffs in place, experts suggest Trump may pursue alternative legal routes to continue his trade actions.


Legal analysts warn that President Trump and his administration could reframe executive orders or invoke other trade statutes—such as Section 232, Section 301, or even rarely used authorities like Section 338 of the Tariff Act of 1930—to maintain tariffs.

Trade advisor Peter Navarro and others emphasize that even if the current legal challenge succeeds, the Trump team has multiple options to keep applying tariffs, with some suggesting that the effort to impose trade restrictions will persist in some form.
